Public Utilities Code:

​

  • Requires providers with gross annual California revenues exceeding $15,000,000, but not more than $25,000,000 to submit data on procurement from women, minority, disabled veteran, and LGBT business enterprises.

  • Corporations with gross annual revenues exceeding $15,000,000 to annually submit a detailed and verifiable plan for increasing procurement from these enterprises.

  • Encourages investor-owned utilities and their Prime Contractors to purchase at least 21.5% of goods and services from women; minority; lesbian, gay, bisexual and transgender (LGBT); and disabled veteran owned businesses.

​

​

  • 23% of Federal prime contract dollars shall be awarded to small businesses, with individual prime and subcontracting goals for certain identified small business groups.

  • The Federal government must award 5% of its prime and subcontract dollars to women owned small businesses.

WOSB Sole Sourcing:

For requirements in industries designated by SBA as substantially underrepresented pursuant to § 127.501, a contracting officer may issue a sole source award to a WOSB when the contacting officer determines that: 

​

  1. The WOSB is a responsible contractor with respect to performance of the requirement and the contracting officer does not have a reasonable expectation that 2 or more WOSBs will submit offers; 

  2. The anticipated award price of the contract (including options) will not exceed $6,500,000 in the case of a contract assigned a NAICS code for manufacturing, or $4,000,000 in the case of any other contract opportunity; and 

  3. In the estimation of the contracting officer, the award can be made at a fair and reasonable price.
